为了准确认定职务侵占罪的主体,本文从争议较大的职务侵占罪主体中的'单位'和'人员'进行剖析,从职务侵占罪的立法本意出发,应扩大职务侵占罪主体的范围,只要与单位存在劳动关系的员工利用职务便利,侵占了单位财产,就可成为职务侵占罪的主体。
In order to accurately identify the subject of official encroachment crime,this article carries on an analysis from the controversial"unit"and"staff"from the subject of official encroachment crime.On the original intention of legislation of official encroachment crime,the scope of the subject of official encroachment crime should be extended.As long as employees took take advantage of the labor relations to encroach the property of the unit,the employee can become the subject of official encroachment crime.
