摘要
家事代理范围是家事代理权制度的重要内容,我国拟采纳何种立法模式对其规范具有现实意义。文章通过对域外"概括"的单一立法模式和"概括+否定"的混合立法模式的比较分析,结合我国相关司法实践,通过对概括说、列举说、折中说等理论的阐析,提出我国宜采纳概括与否定结合的混合立法模式,确定我国家事代理的应然范围。
The scope of family agency is an important part of the family agency system.What kind of legislative model China intends to adopt has practical significance for its regulation.Through the comparative analysis of the single legislative model of'generalization'outside the domain and the mixed legislative model of'generalization+negation',combined with the relevant judicial practice in China,through the analysis of general theory,enumeration theory,eclectic theory,etc.Adopt a mixed legislative model combining generalization and negation to determine the scope of Chinese family agency right.
