摘要
马肖的《创设行政宪制:被遗忘的美国行政法百年史(1787—1887)》不仅颠覆了以往"美国行政法肇始于州际贸易委员会"的学界共识,同时也拓宽了学界对于美国行政法研究的视野。寻踪1787—1887年美国早期行政法发展史,深入行政系统内部,重新认识美国早期行政组织架构理念、行政程序和行政组织规范,梳理美国早期行政自我规制的塑造历程,对于学界正确认识行政内部的法律运作、感知行政法律的双重使命和完整理解美国早期行政宪制锻造具有重要意义。
Jerry L. Mashaw’s new book, Creating the Administrative Constitution: The Lost One Hundred Years of American Administrative Law(1787-1887), not only overturns the past academic consensus which holds that 'American administrative law begins with the establishment of the Interstate Commerce Commission', but also widens the field of the research on American administrative law. Pursuing for the early history of the development of American administrative law, penetrating into the administrative internal system, re-recognizing the early concept of administrative organizations, administrative procedures and administrative organization rules of the US, combing the early administrative self-regulation courses of the US, are of great significance for the academic circle’s to recognize the administrative internal operation of law correctly, and to appreciate the dual tasks of administrative law, as well as to understand the early administrative constitutional forging of America completely.
