诚实信用原则作为统帅整个民法领域的“帝王条款”是从德国民法中移植的,它由道德心理、法律规范和客观事实三个层面构成,对平衡当事人之间及其与社会之间的利益起着重要作用。
The principle of good faith,that is called 'Emperor Clause' which govemes the whole area of civil law,comes from the Germanic civil law.It has three-level structure:moral psychology,law provision and objective fact.It is important to balance the interest between citizens and society.
