摘要
联合国安理会授权设立的前南斯拉夫和卢旺达国际刑事法庭无疑是国际法律实践上的创举,也是国际法在世纪之交发展的里程碑。而两个临时性国际法庭的建立也为以后建立的国际刑事法院、塞拉利昂法庭、柬埔寨法庭和黎巴嫩法庭提供了国际刑事审判的宝贵经验。对前南国际刑庭和卢旺达国际刑庭的历史回顾,将使我们更好地总结国际法与国际刑法在发展过程中的经验与教训,有利于促进国际社会以及各个国家的法治建设。
The establishment of the two international criminal tribunals for Yugoslavia and Rwanda by the UN Security Council was undoubtedly a remarkable milestone in the history of the development of international law at the corner of new millennium.The two tribunals also set up an international paradigm for the subsequent tribunals like Sierra Leon as well as Lebanon for international criminal charges.This paper is trying to make an overall review on the major two international criminal tribunals,to get a better vision of the development of international law,especially international criminal law,and to promote the international rule of law both on the international and domestic level.
