摘要
近年来,随着信息技术的迅速发展,跨境数据流动呈现爆发式增长态势。然而,从2013年斯诺登事件到2018年Facebook数据泄露丑闻,数据泄露事件日益严重和频繁。越来越多的国家因此开始对跨境数据流动实行规制,而越南则通过《网络安全法》中的数据本地化储存条款对跨境数据流动进行了较为严格的监管。本文结合当前越南互联网治理的现状,从安全和主权的角度分析了数据本地化储存规则对越南的重要意义。在反思越南数据本地化储存引起的正负面效应的基础上,从公民、跨国公司、全球数字经济三个层面出发,探讨数据本地化储存立法对各国的启示意义。
Recent years have witnessed the explosion of trans-border data flows owning to the rapid growth of information technology.On the other hand,data breaches,marked by incidents including the disclosure of NSA’s PRISM program in 2013 and Facebook data breach in 2018,occurs in a severer and more frequent manner than ever.As a result,a growing number of nations have implemented laws and regulations on trans-border data flows,and Vietnam has put trans-border data flows under strict surveillance through data localization regulations of its new cybersecurity law.From the cybersecurity and cyber sovereignty perspectives,this paper aims to analyze the significance of data localization regulations to Vietnam based on the status quo of its cyberspace governance.It also seeks to discuss the implications of data localization laws for nations at citizenship,corporation and the global digital economy levels through reflecting on the positive and negative effects to which Vietnam’s data localization regulations have contributed.
