摘要
在司法实践中,在校生非理性犯罪类案件具有案发诱因的轻微性和危害后果的严重性反差极大的特征。文章以2010-2014年中国裁判文书网我国大陆11个省市14-34岁21名在校生因生活琐事实施非理性犯罪为样本,研判当前该类犯罪的现状和特点,指出涉案学生自身的性格缺陷以及低自控或低自珍的心理特征,是引发负面情绪以及犯罪行为的根本原因。在此基础上,提出一方面通过提高家长的教育水平,提升家庭教育品质使青少年增强与家庭的情感联接,形成健全人格,另一方面通过学校加强综合管理,尤其是强化大学生和学校的纽带与联系,帮助青少年自我探索,以此增强该类犯罪预防的针对性与实效性。
In judicial practice,the students' irrational crime cases are often with the characteristics of insignificant incentives and serious consequences. The essay takes 21 students' irrational crimes caused by life trifles on campus from 11 provinces of mainland,aged from 14 to 34,between 2010 to 2014,gathered from Chinese referee documents website as sample to analyze the current status and characteristics of this kind of crime,and points out that the character flaw of the involved students,the psychological characteristics of low self- control and low self- respect are the primary causes of the negative emotion. Based on the conclusion mentioned above,this essay also suggests to,on one hand,improve the quality of family education by improving the parents' education level to enhance teenagers' emotional connection to their family to make a healthy personality; on the other hand,to strengthen the comprehensive management of school,in particular,strengthen the ties and contact between students and the school,help teenagers of their self- exploration,to enhance the pertinence and effectiveness of this kind of crime prevention.
