摘要
高碳艺术是一类损害艺术主体精神健康的艺术文本,它主要包括致瘾性极强的互动性数字艺术、淫秽低俗艺术和各种形式的虚假艺术三大范畴。三种高碳艺术对艺术主体造成的精神损害程度和损害内容存在明显的差异,但所有这些损害都具有明显的特定性。这种精神损害既不同于人类各种神经病症和精神病变的非特定性病理学,也不等同于法理上的人格侵权,是当代人工智能型社会一种新型的、日趋严重和普遍的、影响人类精神健康的侵权行为。遏制高碳艺术精神损害,首先需要破除艺术无害论的束缚,增强精神健康维权意识;其次要从法理上阐明艺术质量标准,建立艺术主体精神损害甄别、勘验和救援机制;根本之策还在于艺术立法,为人类艺术行为确立自由的边界,确保和捍卫人类的身心健康权利。
High-carbonized arts,generally consisting of the interacitive digital arts with high-addictiveness,the porn arts and the false arts with diverse artistic forms,seriously damage their recipients' mental health with differential harm levels and objects,all of which can present obvious specificities.Mental damages are not only different from all kinds of non-specific human nerve disorders,but also different from all kinds of personality tort of jurisprudence,which is a new kind of tort acts against human mental health with high severity and universality in the current artificial intelligence-based society.Feasible measures to control such human mental damages of high-carbonized arts should focus on three approaches:firstly,to get rid of the bonds of traditional thinking of the so-called'art is harmless'and establish the new idea of mental health right protection;secondly,to clarify an artistic quality standard and set up the system of discrimination,examination of mental damages and the corresponding assistance mechanism;thirdly and also most essentially,to carry out a legislation procedure for human artistic acts to protect the human right of mental health.
