摘要
为了保护环境,世界各国都采取了支持可再生能源发展的措施,其中之一就是提供补贴。可再生能源补贴尤其是其中的当地成分要求与现行《SCM协定》补贴规则并不一致。可再生能源补贴也未必满足一般例外条款的核心要求。在可再生能源领域制定新的补贴国际规则是比较合适的选择。
Currently,many states have taken measures in the form of subsidies to support the development of renewable energy so as to protect the environment.However,renewable energy subsidies such as local content requirement are not consistent with SCM Agreement,and may not be justified under general exception clause,especially procedural requirement.Therefore,it is appropriate to establish new international rules in this respect.
