摘要
从'送法下乡'到'迎法下乡'的范式转换是乡土司法研究的重大理论创新。当下的中国农村,农民的权利意识日益彰显,主张权利的行为也在不断增多,人际关联的模式出现了新的变化,乡村司法实践的场景和逻辑发生了巨大变化。在新的格局下,乡村权威在日常的纠纷调解实践中,已经不再是无所不及,而越来越青睐于'选择性治理',法律下乡逐渐具备了实践的社会基础,现代法律逐步成为保障农民权益的重要武器。但是,仅有现代法律并不能为乡村社会提供良好的秩序来源,在当前和今后一个相当长的历史阶段,构建规则多元化的法律实践图景是实现乡村'善治'的关键。
The modal alternation has changed from“sending law into the countryside”to“inviting law into the coutryside”,which is the most important innovational theory for the judical study through rural area.Instantly,rural people in China has increseing their awareness on human rights day by day,compare with the past,people claiming their own rights also become more oftenly.Meanwhile,there was the new change on interpersonal association patterns,it makes a huge trasformation on the the rural scenes and the rural logic of judicial practice.Under the new situation of the sociality,authority in routine dispute resolution practice in rural villages that is no longer a perfect way to solve all the problems,and more in favour of“selective governance”,gradually with the social basis of the practice of law,nowaday,modern law has develped in an important weapon to protect all the rural people's rights and inerests.However,only a modern legal cannot be a source of rural society providing good order,at present and future,the construction rules for a wide range of legal practice scences could achieve“a good governance”in the village.
