摘要
行为具有一定的社会危害性是犯罪的基本特征 ,也是本质特征。如何准确把握犯罪行为的社会危害性是正确区分罪与非罪、罪轻与罪重的重要环节 ,是实现“罪刑均衡”的前提。只有坚持联系、发展的观点 ,坚持具体案件具体分析 ,方可准确对犯罪行为的社会危害性作出估量。
The fundamental feature of crime is the harmfulness of offensive behaviors.How to master it is an important link of distinguishing crime and non-crime,minor crime and major crime,as well as the premise of balance between crime and punishment.As a result,the concept of development and connection should be stuck to in different cases' analysis so that the harmfulness of the offensive behaviors can be properly evaluated.
