摘要
以2008年为界,我国新世纪关于人民调解的研究分为前期和后期两个阶段。其中,近十年(2008—2017年)有关人民调解'枫桥经验'的研究又聚焦两个方面:在实证性研究层面,着重关注人民调解的组织建设、工作领域、机制方法、功能作用等;在规范性研究层面,将研究对象放置到多元纠纷解决机制、社会治安综合治理、基层社会治理、中国特色社会主义法治等中国法治话语体系中予以诠释。但相关研究尚未形成足够的学术积累,局限于地方性知识,对人民调解实践的理论总结与提升不足。未来应在探索人民调解的内外部关系,政府推动和群众自治双轮驱动机制,寻找法律治理与传统治理方式的平衡,发掘中国特色社会主义法治样本的意义等方面予以加强。不仅要重视人民调解在社会矛盾预防化解体系中的重要作用,而且要挖掘其对基层法治研究的典型意义。
The research on people’s mediation in China can be divided into early and late stages in 2008as a time node.The study of people’s mediation'FengQiao Experience'in past ten years mainly focuses on two aspects,one of which at the ontological level concentrate on people’s mediation organization construction,work area,mechanisms,methods,functions,etc,the other of which in value level,places the object of study to the multiple dispute resolution mechanism,public security comprehensive administration,fundamental social governance,the rule of law of socialism with Chinese characteristics the Chinese discourse system of rule of law,such as observation and interpretation.Relevant researches have not yet formed enough academic accumulation,which is limited to local knowledge,and the theory of people’s mediation practice is not improved.Future research should explore government impetus and self-governance two-wheel driven mechanism,seek the balance of legal management and traditional management way,and explore the meaning of the rule of law of socialism with Chinese characteristics samples three aspects to strengthen,which should not only attach importance to the mediation work in social contradictions melt the system the important role of prevention,but also understand the mediation model and operation mechanism of grass-roots problems such as the rule of law study of typical significance.
