摘要
在分析“两抢”案件发案特点的基础上 ,主张引入“危险倾向人员”概念 ;在网络控制前提下 ,加强对出租房的监控与管理 ,对“危险倾向人员”进行重点监控 ;对抢夺罪认定中的疑难问题作出分析 ,认为对随附暴力强度较大的行为不应一律以抢劫罪论处 ;主张把抢夺罪界定为以非法占有为目的 。
The conception of Dangerous Personnel are supposed to be used based on the features of the crime of mug and mulct; The rented houses should be put into close control and surveillance, especially for the dangerous personnel; Act with rather big violence are not bound to be punished as the crime of mug; the definition of the crime of mulct is advised that the act takes suddenly others a large amount of money and things by force with the purpose of illegal possession.
