摘要
经济法基本原则的确立,一直是经济法理论中重要的难题。本文提出了经济法基本原则的三项确立标准和两种确立方法,并据此概括出三项具体的基本原则,即调制法定原则、调制适度原则和调制绩效原则。
It is still an important, difficult problem in the basic theories of economic jurisprudence to establish fundamental principle of economic law. This paper advanced three criterions and two methods for establishing fundamental principle of economic law and hereby established three fundamental principles. The three fundamental principles are the principle of legal regulating, the principle of moderate regulating and the principle of efficacious regulating.
