摘要
社会保险争议处理机制变革方向应是去私法化,劳动争议处理机制客观上造成强制的社会保险演变为商业保险。社会保险行政争议处理机制不畅,亦是源于对私法化的坚持。为此,需剥离社会保险劳动争议处理机制,完善社会保险行政争议处理机制以适应社会保险特殊性。同时,构建独立的社会保险争议处理机制将是未来的发展趋势。
Social insurance dispute processing mechanism change direction should be to civil laws, labor dispute processing mechanism objectively caused the compulsory social insurance for commercial insurance. Poor social insurance administrative dispute processing mechanism, is also from the insistence of civil laws. Therefore, need to be stripped of social insurance of labor dispute processing mechanism, perfect the mechanism to adapt to the particularity of social insurance. Building independent social insurance dispute processing mechanism will be the trend.
