摘要
劳动法、海商法和破产法三重法律框架下的船员报酬请求权特征各异,关系密切。应在仔细剖析该项请求权具体构成和明确其法律适用的基础上,关注三种法律制度交织影响下的船员报酬请求权在劳务派遣关系中的互动作用,并注意到这种互动作用对船员报酬请求权可转移性及优先受偿性的影响。我国《海商法》需依据相关国际公约进行一定的完善;未来民法典应参考外国法在总则部分对债权的转让及代位作出明确的原则性规定;上海自贸区亦宜先行开展建立跨国(境)破产法律框架的探索。
Seafarers' wage claims under the respective frameworks of labor law, maritime law and insolvency law are closely related despite their distinctive features. Special attention ought to be paid to the interaction among between three types of wage claims in labor dispatching by examining the inner structure of the claims and ascertaining its proper law. This interaction influences the transferability and priority rank of the claims. It is hereby held that Chinese Maritime Law requires amendments, that future Chinese Civil Code should lay down the fundamental rules on the assignment and subrogation of debt, and that Shanghai Free Trade Zone may take the initiative in the establishment of the framework of cross-border insolvency.
