摘要
属于企业无形资产的商业秘密 ,可以为企业带来现实的经济利益或潜在的竞争优势 ,而商业秘密的失窃则可能导致企业巨大的损失。随着我国法律制度的不断完善 ,法律上对商业秘密的保护已成为现实可能 ,企业可以通过反不正当竞争法、劳动法、合同法等加以保护。企业在新的形势下对商业秘密的保护应有新的思路。
Trade secrets, as the intangible assets, can bring practical or potential economic benefits or competitive preponderance for the enterprises. Otherwise, immense loss would be caused if the trade secrets were stolen. With the continuously consummate of Chinese legal system, it's completely possible to protect trade secrets in law. The enterprises may apply the law adequately for the protection of trade secrets, such as The Anti-Unfair Competition Law, Labor Law, Contract Law, etc.. To sum up, there should be some new measures for the enterprises to take in protecting the trade secrets when facing the span-new situation.
