摘要
经济发达国家对科技成果转化的法律制度 ,无论是从立法体系、明确政府职能、鼓励科技创新主体合作、促进科技与经济结合、完善科技成果转化资金保障、税收优惠等方面均可以给中国相应的启示。中国的科技成果转化环境方面还存在着立法、具体的法律实施等方面仍有必须完善的地方。在知识经济时代 ,加快中国科技成果转化法律制度建设 ,促进科技制度改革是历史的必然。
The legal system in developed countries for the transformation of scientific nd technical achievements into practical use can provide China with some enlightenments in the legislation system,making definite the government's function,encouraging the cooperations among scientific research bodies,promoting the combination of science & technology with economy,perfecting the fund protection for transformation of scientific and technical achievements,giving taxation preference and etc.There are still some drawbacks in the environment for transformation of science and technology in China,such as legislation,and practical law enforcement.In the times of intelligence economy,it is an inevitable trend to speed up the construction of China's legal system for transformation of scientific and technical achevements and further the reform of scientific and technical system.
