摘要
我国食品安全黑名单制度已经具备一定的基础和经验,但是也存在规范层次较低、技术粗糙、上位法依据不足等缺陷。平衡并处理好权利冲突是黑名单制度制定者的重要任务,公民的生命权、健康权、知情权或食物权需要保障,而企业的营业权、商誉权同样需要尊重,我国食品安全黑名单制度在适用情形、内容、程序等方面有可取之处,但是急需完善。
Food safety blacklist system in our country has certain foundation,but its standard is low,the technology is rough,and its host law basis is insufficient. To balance and deal with the conflict of rights is an important task for blacklist system decision- makers. The citizens' right to life,the right to healthy,the right to know or the right to food need safeguard measures,whereas enterprise's business power and business reputation also need to be respected. The situation,content,procedures of food safety blacklist system in our country have much to recommend,but it needs to be consummated urgently.
