摘要
近期,美国运用301条款对我国展开所谓的有关知识产权的贸易调查,从而引发世界关注。首先,本文剖析了301条款的内涵及其调查实施历史,从中窥探出其单边主义、贸易保护主义特性。其次,本文分析了301条款产生的思想根源、社会根源和现实基础,认为,如果该调查升级为贸易战,那么不仅会对中美经贸产生一定负面影响,而且会对世界经济发展、国际规则运行产生负面效应,并会对全球化进程产生一定破坏作用;但是,基于中美之间的产业互补、贸易依存、战略合作以及中国雄厚的综合实力,中美之间虽然贸易摩擦不断但发生贸易大战的概率却较低。最后,本文认为,应对301调查中国应多管齐下、综合施治,既要高度重视、坚守原则,又要灵活应变、加强沟通谈判;同时,应继续实施科技创新和市场多元化战略,依据国际规则对美方的单边主义贸易保护行为进行必要的反击。
In August 2017,US Trade Representative Robert Lighthizer initiated the Section 301 Investigation against China for intellectual property violations.This following research traces the historical context and several cases of the 301 investigation,revealing the 301's unilateral and arbitrary nature.Viewing the current Section 301 Investigation with historical context,this article argues that the investigation against China originated from multiple causes:economic,social,and ideological.Should the investigation triggered trade war,the article deduces,it would not only hinder the economic growth of both parties and,even,of the world,but would also challenge international trade customs and the progression of globalization.However,the article admits that,due to the complementary nature of Sino-US trade partnership,the interests of both sides,and China's strong economic foundation,it is unlikely that large scale trade war bursts out,though conflicts in a smaller scale is probable.Towards the end,this study concludes that,in response to the 301 investigation,China should actively negotiate and take necessary actions according to trade customs;at the same time,China should continue its supply-side innovation and diversification so that the potential loss of the 301 investigation is minimized.
