摘要
作为一种尚未被我国法律规范所明确规定的行为,滥用相对优势地位的规制引发了不少争议和讨论。本文从相对优势地位的界定出发,通过研究相对优势地位的理论依据、相对优势地位的成立要件以及各个法域的规制经验,总结出相对优势地位滥用的构成要件,并对相对优势地位的规制提出建议。
As a behavior that is not explicitly regulated by China's laws and regulations, abuse of superior bargaining position has been a controversial topic among legal scholars. By discussing the definition of superior bargaining position, the fundamental theory of superior bargaining position, the constitutive requirements of superior bargaining position and other jurisdictions' regulation experiences, this article tries to provide suggestions re the regulation of abuse of superior bargaining position.
