摘要
随着刑事司法系统的各项职能趋于完善,法庭对被告人的定罪和量刑变得更加公正,但是在美国司法界,不公平的定罪仍时有发生。本文从刑事侦查过程中出现的思维失误而导致的错误定罪入手,从认知偏见、组织弊端、可能性错误等三个方面深入探讨侦查思维错误的原因及其表现,进而提出预防侦查失败的可行性对策。
Although the various functions of the criminal justice systems tend to perfect,and the judge's conviction and condemnation for the defenses are more and more impartial,the facts of unequal conviction do occur occasionally.The causes leading to false conviction are intricate.The article,from the cause of thinking error in the process of criminal investigation,discusses the reasons,presentations,and the actual cases.Thinking errors involve three aspects in cognitive biases,organizational malpractice,and probability errors.To conclude is the operational strategy to prevent investigative failures and its implications.
