摘要
虚假破产罪为惩罚破产诈欺行为,其保护法益众说纷纭。有个人法益说也有社会法益说,然虚假破产罪究竟保护的何种法益,需从违法逻辑、犯罪实质等方面综合考虑。
In order to punish bankruptcy fraud behavior, bankruptcy fraud is published. But the Legal interest of it is not clear. We should judge its legal interests from illegal considering logic, crime essence, etc.
