摘要
当前,有不少国家通过建设专门的国际商事法院提升跨国商事审判的专业化水平,从而增强本国司法的国际竞争力。从当代国际商事法院的发展来看,国际商事法院具有组织架构专业化、司法人员精英化和国际化等特点。这些新兴国际商事法院创新律师代理制度,允许外籍律师在一定条件下以律师身份代理诉讼。中国国际商事法庭的设置服务于"一带一路"的建设与发展,是国家政策驱动型法院。作为最高人民法院的常设审判机构,中国国际商事法庭强调争端解决的效率,但忽视了上诉机制的价值和功效。在法官的国际化和外国律师在中国执业问题上,无论是受限于现有法律的规定,还是中国司法发展的需求,中国都应谨慎行事,着眼未来,培养自己的中坚力量。
In recent years,many countries have newly established international commercial courts in order to promote the specialization of international commercial litigation,thereby improving the global competitiveness of their judicial system.In terms of the characteristics of the emerging international commercial courts,the organizational structures of those courts tend to be specialized and the judicial staff appears to be professional and internationalization.Meanwhile,some burgeoning international commercial courts also reform its lawyers’rules under which foreign lawyers are entitled to represent the case parties in the capacity of lawyer in certain circumstances.The establishment of the China International Commercial Court(CICC)aims to serve the building and development of the Belt and Road,therefore the CICC is a policy-driven court.As a permanent judicial body of the Supreme People’s Court,the CICC attaches more importance to the efficiency in dispute resolution but overlooks the value of appeal procedure.Regarding the issues of whether to appoint international judges and allow foreign lawyers to practice in the capacity of lawyer in China or not,China shall think twice before acting.Taking the restrictions of current Chinese law and the needs of judicial development into consideration,China shall look to the future and cultivate excellent legal talents.
