The Examination and Review of the Reform of Chinese Educational Administrative Approval

摘要 本文通过对我国教育行政审批改革历程的梳理,找出其在不同改革阶段的特征,检视其存在的问题。以往的教育行政审批改革的不足集中表现为法治化程度不高,具体表现为改革难免带有形式化、运动式的印记,改革过程缺乏公众参与,非行政许可审批呈潜在增长趋势等,进而提出以下对策和建议:通过制定权力清单,公布负面清单;完善外部监督机制;完善动态的决策机制,促进改革的科学化、民主化;取消非行政许可审批,推进改革的法治化。 Through reviewing the historical development of the reform of Chinese educational administration approval,the author concluded the characteristics of different phrases of the past reform and exanimated the existing problems.The author suggested that the primary drawback of the pastreform was the inadequate level of legalization.To be more specific,the previous reform was characterized by pro forma statements,radical movements.lacking of public participants,and increasing number of non-administrative approvals.The implications for future educational administrative approval reform include making rights lists,publishing negative lists,improving external supervision mechanism,improving dynamic decision-making mechanism,promoting the scientific and democratic level of the reform,prohibiting the non-administrative approval,and advancing the legalization of the future reform.
