摘要
民法典专家建议稿婚姻家庭部分中 ,有关父母子女、祖孙和兄弟姐妹关系一章在 2 0 0 1年婚姻法修正案的基础上 ,主要增加了反歧视原则、子女亲生否认、认领子女、强制认领、父母的亲权责任、禁止使用对未成年子女身心健康有害的惩罚手段 ,以及收养关系的有关规定。将收养法并入婚姻家庭法编 ,单立一章。祖孙和兄弟姐妹作为重要的家庭成员在父母子女关系一章里专立了一节 ,并增加了有关扶养制度的基本原则规定 ,统一“赡养”“抚养”“扶养”为“扶养” ;增加了扶养的程度、方式、争议处理办法的原则规定 ,弥补了我国婚姻法缺少系统的扶养制度的空白。
In the chapter on these relations in the draft Civil Code, based on the amendment to Marriage Law in 2001, anti-discriminatory principle, denial between parents and children, child adoption, forcible adoption, parents' rights and obligation as parents, prohibition of punishment harmful to children's body and mentality, and the adoption relation are added. The law on adoption is incorporated into the law on marriage and family. As important members in family, the relation between grandparents and grandchildren and brothers and sisters are stipulated in a section in the chapter on the relation between parents and children, and the basic principle on'supporting and assisting' is added. 'Supporting','upbringing' and 'supporting and assisting' are unified into'supporting and assisting'. The principle on the level, method of supporting and assisting and the way to deal with the problems therefrom are supplemented. These are more or less filling the blank in the Marriage Law which doesn't provide the systematic supporting and assisting.
