摘要
2013年1月1日起正式施行的《最高人民法院关于审理侵害信息网络传播权民事纠纷案件适用法律若干问题的规定》,为热播影视作品的侵权责任认定提供了较为完整的法律依据。但仅针对高知名度的作者、作品的"注意义务"作出了规定,在法律设计上存在不合理性,在司法实践中带来不确定性,同时不利于文化强国的建设。从网络音频服务商的侵权案例出发,探讨数字著作权环境下立法、司法、现实三个维度对"利益平衡"原则的运用和实践,并提出应对热播影视作品与非热播影视作品予以同等保护;应以完善"注意义务"为中心,健全UGC音频信息网络传播权的保障体系。
The Provisions of the Supreme People’s Court on Several Issues Concerning the Application of Law in Hearing Civil Dispute Cases Involving Infringement of the Right of Dissemination on Information Networks officially implemented on January 1, 2013 provides a relatively complete legal basis for the cognizance of tort liability for popular movies and TV works. However, this regulation only aims at the elements of duty of care of high-profile authors and works. It is unreasonable in legal design and brings uncertainty in judicial practice;at the same time, it is not conducive to the construction of a culturally powerful country. Starting from the infringement cases of network audio service providers, this study discusses the application and practice of the principle of balance of interests in three dimensions of legislation, judicature and reality under the digital copyright environment. It also points out that the less-popular movies and TV works should be equally protected as the popular ones. Moreover, we should center on the perfection of the duty of care and improve the system of UGC audio information network communication rights.
