WTO体制下亚洲加价之非法性

摘要 亚洲加价是指亚洲国家自中东进口原油时比欧美国家平均支付更高的价格,其原因是以沙特阿美石油公司为首的中东国家石油公司对出口实施模式定价并施加目的地条款限制。本文从法学视角论证:沙特阿美石油公司构成WTO法上的国营贸易企业;模式定价理念本身与WTO相关规则没有根本冲突,但是其实施缺乏透明度,尤其是与目的地条款相结合具有非法性。中国政府对此应有充分的认识,并联合其他亚洲国家寻求终止该价格歧视之做法。 The Asian Premium is the price margin paid by Asian countries for the Middle East crude oil compared with Europe and North America.The Destination Clause restriction,which is typically imposed by Saudi Aramco,in combination with the Formula Pricing system,is the origin of it.This paper takes Saudi Aramco as an example and argues from the legal perspective that,firstly,Saudi Aramco constitutes a State Trading Enterprise under the WTO law;secondly,though lack of transparency,the Formula Pricing policy is not in conflict with relevant rules in principle,while the Destination Clause is the Achilles’heel that renders the pricing system and the Asian Premium fundamentally illegal.Chinese government should have full knowledge about this and unite with other Asian countries to seek suspension of this price discrimination.
