摘要
自从20世纪80年代末期以来,经济全球化促成了国际投资法的第二波即自由化浪潮,与此同时,经济全球化、可持续发展、非政府组织的兴起和全球民权运动则推动了国际投资法第三波即社会化浪潮。社会化浪潮主要体现为国际投资的利害相关者即地方民众、土著群体和非政府组织通过跨国层面的社会协商、民权运动、议会民主、司法诉讼等诸种途径,要求跨国公司承担社会责任,要求民族国家保障社会民权,要求国际组织考量社会诉求。第三波浪潮主要表达了受到国际投资和跨国公司直接和间接影响的环境、健康、劳工和发展领域的经济、社会、文化以及与之紧密关联的自由、民主、人权的利益和价值。
Since the late nineteen eighties,economic globalization stimulates the second wave of international investment law—the tide of liberalization.At the same time,economic globalization,sustainable development,rise of non-governmental organizations and global civil rights movement promote the third wave of this field of law—the tide of socialization.During this process,all kinds of stakeholders or constituents of foreign direct investment such as local people,indigenous groups and non-governmental organizations claim by means of transnational social consultations,civil rights movements,representative democracy and judicial actions,that transnational corporations share social responsibility,that nation-state protect civil rights and that international organizations take social appeals into account.The tide of third wave mainly expresses diverse interests and values of economy,society,culture,liberty,democracy,human rights directly and indirectly influenced by foreign direct investment and transnational corporations in the fields of environment.
