THC争议与海运业反垄断豁免问题

THC Disputes and Exemption from Anti-trust in Marine Industry

摘要 国际班轮公会及运价组织联合非公会船东决定于2002年1月对中国货主强行收取THC,并认为收取THC是国际惯例,中国入世后在收取THC上应与国际接轨。该争议涉及班轮公会的性质、航运业的反垄断豁免及限制、班轮条款的适用等法律问题。THC之争也使中国入世后反垄断立法的完善、政府职能的转变及行业协会作用的发挥等问题凸现。 The thesis discusses relevant legal issues resulting from the matter that International Line Conference and other Shipping Lines began to impose THC on owners of cargo from China from January 2002.This dispute concerns the nature of Shipping Lines,application of Shipping Line clause,implication of international trade terms,unfair competition,anti-trust and other legal issues.This thesis put emphasis on the issues of monopolistic nature of Shipping Lines,exemption from and restriction on anti-trust in marine industry,imposition of THC in other countries,and whether the imposition of THC is an international practice,and so forth.
