摘要
网络技术在当代社会中的飞速发展和广泛运用,导致传统《著作权法》保护的各种类型的作品都可以在数字化后被便利快捷地复制和传播,使得著作权侵权行为在信息网络上的日益泛滥。著作权人为了保护自己的权益纷纷采取各种科技措施,然而这些措施亦有遭到规避的危险。我国《著作权法》2001年修订后首次增加了反规避条款,而司法解释和行政法规更扩大了反规避条款调整的范围。本文通过对现有著作权科技保护措施及其规避现状的介绍,分析了我国《著作权法》中的反规避条款目前存在的各种问题,为反规避条款未来的发展提出了建议。
In the contemporary society,the rapid development of information network technology causes all kinds of works which are safeguarded by traditional copyright law could be copied conveniently after the digitization.It causes the flooding of the copyright infringement behavior in the information network day by day.The copyright owners want to safeguard their rights and interests.So they take each kind of technical measure.However,these measures also,inevitably,is faced with the danger to be circumvented.Chinese copyright law was revised in 2001.Anti-circumvention article was added into this law for the first time.Then the judicial interpretation and the administrative rules expanded anticircumvention article’s scope.This paper indroduced the existing copyright technical protection measures and circumvention.Then it analyzed the anticircumvention articles’problems in Chinese copyright legal system.And finally,It put forward the proposal for the anticircumvention articles’development in the future.
