摘要
当前形势下,海洋领土与权益纠纷是中国与东盟环南海国家的重要政治议题。随着南海仲裁案的告终,东盟环南海国家以对抗等传统方式解决海洋争端的国家意志正在消退,区际间紧张的政治氛围逐渐得到缓解,谋求合作的政治空间逐渐扩张。可以说,在此契机下筹划建设中国——东盟海上执法合作机制不仅符合"21世纪海上丝绸之路"和"命运共同体"等国家战略的需要,同时该区际性和功能性的合作在缓和中国与东盟环南海国家海上矛盾、增益多边关系上具有巨大潜力。本文以中国与东盟环南海国家海上力量执法合作机制建设为研究对象,通过对海上力量执法合作机制建设的必要性和可行性分析,提出了该机制建设的具体规划与建设路径,以期为国家海洋战略的实施提供一定的支持。
Under the current situation, the dispute on the territorial sea and interests is an important political issue between China and ASEAN countries around the South China Sea. With the end of the South China Sea arbitration, the ASEAN countries around the South China Sea has given up the traditional ways to solve the maritime territorial dispute like confrontation, intense political atmosphere among regions gradually has eased, and the room for political cooperation has improved. It can be said that it is the time for planning the construction of China-ASEAN maritime law enforcement cooperation mechanism. Not only the mechanism conforms to the needs of 'the 21 st Century Maritime Silk Road' and 'Community with a Shared Future' and other national strategies, but also the regional and functional cooperation has great potential for easing the contradiction in the South China Sea Sea between China and ASEAN countries and enhancing the multilateral relations around the South China Sea. If we set the construction of law enforcement cooperation mechanism between China and ASEAN countries as the research object, we can put forward specific planning and construction path of the cooperation mechanism through the analysis of the necessity and feasibility of the mechanism construction, providing some supports for the implementation of National Maritime strategy.
