摘要
对我国体育经纪人法规体系进行了内容和形式的初探 ,阐述了建构体育经纪人法规的意义 ,分析了当前我国体育经纪业立法的现状及存在的问题 :对体育经纪人的从业资格和要求管理松动 ,各地方要求不一 ;体育经纪人乱收佣金的现象大有存在 ;操纵运动员和运动竞赛的现象 ;体育经纪合同缺乏规范性 ;存在偷税漏税的现象等 ,并对建构体育经纪人法规体系进行了探索性构想。
The form and contents of the sports brokers' regulation system in China were studied preliminarily. The significance of establishing the regulation for sports brokers was expounded. The present situation of the sports brokers' service legislation and the existing problems were analyzed. It was found that the employment qualification, demand and management of sports brokers have become a bit more flexible. The requirement of them was different in different place. There exist the phenomena of accepting brokerage without proper standards. The sports brokers often control athletes and competitions. There aren't criteria of contract for sports brokers and tax evasion and tax dodging occur. Finally, the exploratory consideration of setting up sports brokers' regulation and system was put forward.
