摘要
依法治国的核心与实质是依宪治国。法治与宪法和宪政有着天然的联系。法治的基本要求是通过规范和限制政府的权力,以保障公民权利,而这一目标,只有在宪政条件下,才能真正完全地实现。法治的落实,首先要求有一部合乎宪政精神的宪法。只有在宪政条件下的法治,才是完善的法治;只有宪政保障的法治,才是真正的法治。只有实行宪政,才能真正推动法治的发展,实现依法治国的目标。我国已经开始了“依法治国,建设社会主义法治国家”的进程,要实行法治,就必须坚定地贯彻实施宪法,实行宪政。
Ruling the country according to the Constitution is the core and essence of ruling the country according to law.Ruling by law has natural relationship with the constitution and constitutional government.The basic demand of ruling by law is to guarantee the rights of citizens through standardizing and restricting government power;the complete realization of this goal can be achieved only under the condition of constitutional government.The fulfillment of ruling by law first demands a constitution in the spirit of constitutional government.Perfect ruling by law is one under the condition of constitutional government;ruling by law with the guarantee of constitutional government is a real one.Only by carrying out constitutional government can we really promote the development of ruling by law and realize the goal of ruling the country according to law.Our country has started the process of'ruling the country according to law and building up a socialist country ruled by law',therefore,we must firmly carry out and implement the constitution and constitutional government.
