摘要
行政复议机关的定位是行政复议功能预期与实效发挥之间的关键枢纽,复合型功能导致行政复议机关定位不清的问题一直存在。《行政复议法》修订背景下,实质性化解行政争议的功能占据统摄性地位,行政复议呈现出更为浓厚的“准司法化”色彩,行政复议机关应当定位为行政体制内部承担判断职能实质性化解行政纠纷的行政机关。“行政性”作为行政复议机关的属性定位,要求行政复议机关保持既有的争议化解专业性优势;“判断职能”作为行政复议机关的功能定位,要求行政复议机关在行政体制内部的中立地位继续得到强化;“化解行政争议实质化、协调化”作为行政复议机关的职责定位,要求行政复议机关对行政争议全面审查、实质化解。
The positioning of administrative reconsideration organs is the key pivot between the expectation and effectiveness of administrative reconsideration functions,and the problem of unclear positioning of administrative reconsideration organs due to compound functions has always existed.In the context of the revision of the Administrative Reconsideration Law,the function of substantively resolving administrative disputes occupies a dominant position,administrative reconsideration has taken on a stronger“quasi-judicial”style,and administrative reconsideration organs should be positioned as administrative organs within the administrative system that undertake the function of judgment and substantive resolution of administrative disputes.“Administrative”as the attribute positioning of administrative reconsideration organs requires administrative reconsideration organs to maintain their existing professional advantages in dispute resolution;“judgment function”,as the functional orientation of administrative reconsideration organs requires that the neutral position of administrative reconsideration organs within the administrative system continue to be strengthened;and“substantiation and coordination of administrative dispute resolution”,the responsibility positioning of administrative reconsideration organs,requires administrative reconsideration organs to comprehensively examine and substantively resolve administrative disputes.
