摘要
维护法制统一是开展备案审查工作必须坚持的基本原则之一。从一般性角度来说,通过备案审查制度贯彻法制统一原则是厉行法治、发展经济和维护政治稳定的必然要求。马克思主义法制统一思想的影响、维护党中央的集中统一领导以及对不重视法制的历史的反思等因素则是备案审查实施法制统一原则的特殊必要性根据。法制统一原则的核心内容包括宪法至上、法律面前人人平等、权力制约和监督以及人权保障。落实这一原则要求法律体系的建立健全、法律解释的统一性和法律监督的统一性。备案审查在统一法律监督的同时,恰能促进法律解释统一性的达成和法律体系的实质性优化,因而能有效维护法制统一。未来在备案审查中实施法制统一原则应注意协调央地利益配置关系、健全多元多级备案审查体系衔接联动机制和探索统一的审查方法及程序。
Maintaining the unity of the legal system is one of the basic principles that must be adhered to in carrying out the record and review work.From a general perspective,implementing the principle of the unity of the legal system with the help of the record and review system is an inevitable requirement for enforcing the rule of law,developing the economy,and maintaining political stability.The factors such as the influence of Marxist legal unity thought,maintaining the centralized and unified leadership of the Party Central Committee,and reflecting on the neglect of legal history are the special necessity basis for the implementation of the principle of the unity of the legal system in the record and review.The core content of the principle of the unity of the legal system includes the supremacy of the Constitution,equality of all before the law,power restriction and supervision,and human rights protection.The implementation of this principle requires the establishment and improvement of the legal system,the unity of legal interpretation,and the unity of legal supervision.While unifying legal supervision,the record and review can promote the achievement of the unity of legal interpretation and the substantial optimization of the legal system,thus maintaining the unity of the legal system.In the future,the implementation of the principle of the unity of the legal system in the record and review should pay attention to coordinating the relationship between the central and local interest allocation,improving the linkage mechanism of the multiple and multi-level record and review system,and exploring unified review methods and procedures.
