摘要
国家干预市场的制度界限需要通过宪法予以明确。在基本权利和基本经济制度之间,厘定这一界限需要一种价值完备且合乎理性的方法。德国联邦宪法法院在立法审查历史中形成了比例原则审查的方法论,这一路径可以适用于我国,但不同的是,比例原则审查需要以基本权利和我国的经济宪法为双重考量。我国基本经济制度蕴含了国家干预市场的三重价值目标:基本权利、完备的市场秩序以及共同富裕。虽然面临诸多限制和挑战,但比例原则作为一种“目的—手段”理性建构方式,对厘定国家干预的界限有着不可替代的作用。基于干预的价值目标和超越基本权利保护的功能需要,改进比例原则审查方法,可使其形成一种基于经济宪法的全面审查理论,在备案审查等本土的制度实践中发挥更好的效用。
The institutional boundaries of state intervention in the market necessitate explicit delineation through constitutional means.Within the nexus of fundamental rights and the foundational economic structure,the demarcation of this boundary demands a value-laden and rational approach.The methodology of proportionality review,as developed in the jurisprudential history of the German Constitutional Court,presents a viable path that can be applicable in the context of the nation at hand.However,it diverges in that the proportionality review must consider both fundamental rights and the economic constitution of the nation.The economic constitution in this nation encapsulates a triad of values concerning state intervention in the market:fundamental rights,a well-ordered market,and shared prosperity.Despite facing numerous constraints and challenges,the proportionality principle,as a means-end rational construct,assumes an irreplaceable role in defining the limits of state intervention and carries legal basis within the economic constitution.Considering the goals of intervention and its role beyond the protection of fundamental rights,refining the methodology of proportionality review can enhance its efficacy in the domestic institutional practice.
