摘要
随着我国数字产业的不断发展以及政策利好,一批虚拟偶像出现并对青少年产生了深远的影响。虚拟偶像作为“超现实”的存在,不同于传统娱乐业中的明星,其形象是由技术研发部门和受众共同建构的,因此虚拟偶像的代言也会产生法律层面的问题和纠纷。分析目前虚拟偶像代言的现状,探讨虚拟偶像代言存在的法律问题,并且从经济法的角度给出规制建议。
With the development of digital industry and favorable policies in our country,a group of virtual idols have emerged and had a far-reaching influence on youngsters.The surreal virtual idols are different from the stars in the traditional entertainment industry,whose images are jointly constructed by the research and development department and the audience,so the endorsement of the virtual idols will also causes legal problems and disputes.This paper analyzes the current status of the endorsement of virtual idols,probes into the legal problems of the endorsement of virtual idols,and gives some regulatory suggestions from the perspective of economic law.
