摘要
随着区域发展战略的实施和跨区域环境问题的涌现,跨区域环境检察成为检察体制改革的一项重要内容。作为一种跨越行政区划的特殊检察样态,跨区域环境检察协作在推动多元主体基础上的沟通协调、体现地方需求基础上的全局视野、顺应检察改革基础上的创新探索方面具有重要意义。从黄河流域、长江流域以及京津冀区域的典型实践来看,我国跨区域环境检察协作方面形成了兼具创新性和示范性的推进模式,成效显著。同时也存在制度供给缺乏、专门化程度不够、配套衔接机制不完善等问题。基于此,需要围绕制度化要求强化相关制度供给,形成跨区域环境检察的长效机制;围绕专门化要求推进跨区域环境检察专门化进程,着力探索跨区域环境专门检察院建设;围绕一体化要求健全跨区域环境检察协作配套机制,为提升协作水平提供有力保障。
With the implementation of regional development strategies and the emergence of cross-regional environmental problems,cross-regional environmental inspection has become an important part of the reform of the procuratorial system.As a special type of prosecution that transcends administrative divisions,cross-regional environmental prosecution collaboration is of great significance in promoting communication and coordination on the basis of multiple subjects,reflecting the overall vision on the basis of local needs,and responding to the innovation and exploration on the basis of prosecutorial reform..From the perspective of the typical practices in the Yellow River Basin,the Yangtze River Basin and the Beijing-Tianjin-Hebei region,China's cross-regional environmental prosecution collaboration has formed an innovative and exemplary mode of promotion,with remarkable results.At the same time,there are also problems such as lack of system supply,insufficient degree of specialization,and imperfect supporting connection mechanism.Based on this,it is necessary to strengthen the supply of relevant systems around the institutionalization requirements and form a long-term mechanism for cross-regional environmental inspection.Promote the process of specialization of cross-regional environmental procuratorates around the requirements of specialization,and strive to explore the construction of cross-regional environmental specialized procuratorates;Focusing on the requirements of integration,improve the supporting mechanism for cross-regional environmental inspection and cooperation,and provide a strong guarantee for improving the level of cooperation.
