摘要
在国际社会关于改革ISDS机制的讨论中,中国素来有其考量与立场。中国已申请加入CPTPP,CPTPP的ISDS机制虽然被视为改革范式之一,但是其内容并不能完全契合中国的诉求,因此,中国在未来应当如何安排其适用以最大化满足自身利益十分关键。中国在短期内仍然致力于改良国际投资仲裁制度,总体目标是平衡东道国的监管权与投资者保护,推动ISDS机制的可持续发展。CPTPP的ISDS机制包括大范围限缩投资者诉权、强化程序公正以及允许缔约方以换文的方式灵活安排ISDS机制的适用等措施,但这些举措并未促进投资争端解决方式的多元平衡,且上诉机制存在缺位的问题。因此,中国在具体安排中不宜照搬缔约方的已有路径采取“逐案审批”措施,而应谋求强化内国救济的适用,完善调解机制,并预先通过换文的方式来明确早期条约与CPTPP中的ISDS机制的关系。
In the international discourse on reforming the ISDS mechanism,China has consistently maintained its own considerations and stance.China has applied to join CPTPP.While the ISDS mechanism of CPTPP is regarded as one of the reform paradigms,its provisions do not fully align with China’s demands.Therefore,it is crucial for China to strategically arrange its application in a way that maximizes its own interests.In the short term,China remains committed to improving the international investment arbitration system,with the overall goal of balancing the regulatory powers of host states with investor protection and promoting the sustainable development of the ISDS mechanism.The ISDS mechanism of CPTPP includes measures such as significantly limiting investors’rights to initiate claims,strengthening procedural fairness,and allowing parties to flexibly arrange the application of the ISDS mechanism through an exchange of notes.However,these measures have not facilitated a diverse and balanced approach to resolving investment disputes,and there are shortcomings in the appellate mechanism.Therefore,China should avoid adopting a“casebycase approval”approach based on the existing practices of other parties and instead seek to enhance the application of domestic remedies,improve mediation mechanisms,and clarify the relationship between early treaties and the ISDS mechanism of CPTPP through an exchange of notes in advance.
