摘要
当前中国-东盟地区跨境犯罪呈现出新的特点,给区域内国家打击跨境犯罪带来重大挑战,因此,有必要构建中国-东盟常设警务合作机构为各参与方跨境执法合作提供协调平台。人类命运共同体理念、多边主义全球治理观为常设警务合作机构的建立奠定了理论基础,而政治互信的不断增强、法律合作持续推进、执法合作逐步深化等因素则为常设警务合作机构的建立提供了实践基础。在运作中,常设警务合作机构应以东盟警察组织为基础,首先要尊重各参与方的主权、网络安全和数据安全,其次要通过拟订机构章程明确参与各方的权利义务,明确常设警务合作机构的基本职能,从而为警务合作提供方向指引,最后还需要构建常设警务合作机构的组织框架。
At present,cross-border crimes in the China-Asean region show new characteristics,which brings major challenges to the countries in the region to combat cross-border crimes.Therefore,it is necessary to build a permanent China-Asean police cooperation institution to provide a coordination platform for cross-border law enforcement cooperation among member states.The concept of a community with a shared future for mankind and the concept of multilateral global governance have laid the theoretical foundation for the establishment of the permanent police cooperation institution,while the continuous enhancement of political mutual trust,the continuous advancement of legal cooperation and the gradual deepening of law enforcement cooperation have provided the practical foundation for the establishment of the permanent police cooperation institution.In operation,the permanent police cooperation agency should be based on the ASEAN Police Organization.Firstly,it should respect the sovereignty,network security and data security of its members.Secondly,it should clarify the rights and obligations of its members and clarify the basic functions of the permanent police cooperation agency through the formulation of the organizational charter,so as to provide direction and guidance for police cooperation among members.Finally,it is necessary to construct the organizational framework of permanent police cooperation institutions.
