摘要
为一体化保护黄河流域生物和生境、构建统一协同的生物多样性保护管理体制和法制,分析了目前黄河流域生物多样性遭受威胁的现状,指出黄河生物多样性保护法律规制体系缺乏系统性和完整性、综合管理体制不完善、政府生物多样性保护行政职能与责任不匹配、环境司法协作机制存在缺漏等。《黄河保护法》的施行为黄河流域生物多样性保护与恢复提供了法治框架,进而提出黄河流域生物多样性一体化保护法治建构对策,即整合完善生物多样性保护的法律规范体系、健全多元主体参与治理机制、建立促进地方政府生物多样性保护责任有效履行的法律制度、构建多维度的流域生物多样性保护司法协作机制等。
In order to provide reference for the integrated protection of organisms and habitats in the Yellow River Basin from the level of the rule of law and the building of a unified and synergistic biodiversity conservation management system and regime,the current status of biodi-versity in the Yellow River Basin was analyzed.It was pointed out that the legal regulation system of biodiversity protection in the Yellow Riv-er Basin was not systematic and complete,the comprehensive management system was not perfect,the administrative functions and responsi-bilities of the government for biodiversity protection were not matched,and the coordination mechanism of environmental justice had short-comings.The implementation of the Yellow River Protection Law provides a framework for the rule of law for the protection and restoration of biodiversity in the Yellow River Basin,and then puts forward the countermeasures for the rule of law for the integrated protection of biodiver-sity in the Yellow River Basin,integrating and improving the legal normative system of biodiversity protection,perfecting the mechanism for the participation of pluralistic subjects in the management of the system,setting up a legal system that promotes the effective fulfillment of the responsibility of the local government for the protection of biodiversity and building the multidimensional judicial collaboration mechanism.
