摘要
公共数据授权运营是公共数据开放的重要内容,具有正当性,包括统一与分散两种授权模式,并分别对应国有资本运营公司方式与特许经营方式。公共数据特许经营存在公共数据授权范围不清、被授权主体范围不明以及责任承担机制不明等问题。在公共数据授权范围方面,应建立“数据收集—数据登记—数据授权—数据流通”四个阶段的标准化流程。在被授权主体范围方面,只有具备公益属性且拥有较强开发能力的运营机构才能取得运营权限。在责任承担机制方面,若原始公共数据即存在侵权内容,由公共部门承担违约责任;若因被授权企业自身原因侵犯第三人合法权益,由被授权企业承担侵权责任;若二者产生竞合,由公共部门与被授权企业承担比例连带责任。
Authorized operation of public data is a crucial component of public data openness and possesses legitimacy.It encompasses two models of authorization:unified and decentralized,corresponding to state-owned capital operation companies and franchise operations,respectively.Public data franchising faces several challenges,including unclear scope of public data authorization,ambiguous range of authorized entities,and undefined liability mechanisms.Regarding the scope of public data authorization,a standardized flow should be established,comprising four stages of"data collection—data registration—data authorization—data circulation".In terms of the range of authorized entities,only operating institutions with public welfare attributes and strong development capabilities should be granted operational rights.Concerning the liability mechanism,if the original public data are involved in infringement,the public sector should bear contractual liability.If the authorized enterprise infringes upon third-party legal rights due to its own reasons,it should bear tort liability.In cases where both scenarios overlap,the public sector and the authorized enterprise should bear proportional joint liability.
