摘要
检察机关作为法律监督机关,具有确保国家法律统一正确实施的神圣职能,不起诉权作为检察机关的一项基本权力,在检察机关行使法律监督方面发挥重要作用。进入新时代,我国社会主要矛盾发生变化,犯罪结构随之呈现改变,严重暴力犯罪占比持续下降,轻罪占比逐渐上升为主要犯罪类型,我国的追诉模式也由积极主义向便宜主义倾斜,因此,不起诉权的适用空间逐渐扩大。司法实践中,由于不起诉制度不健全、适用标准不统一、尺度把握不严格、救济途径不完善等方面的原因,使得该项制度在实际运行方面存在较为突出的问题。检察机关应立足检察监督办案实际,不断完善顶层设计,构建监督制约机制,创新办案模式,特别是确保相对不起诉制度的科学运行,更好地实现不起诉制度价值目标,助力社会治理体系与治理能力现代化水平提升。
The procuratorial organs,serving as legal supervisory authorities,have the sacred function of guaranteeing the uniform and correct enforcement of the state's laws.The determination of non-prosecution,as a fundamental power of the procuratorial organs,plays a crucial role in the exercise of legal supervision by these authorities.In the new era,as the main societal contradictions in China transform,so does the structure of crimes.Notably,there has seen a decrease in the incidence of serious violent crimes,while the incidence of minor offenses has been increasing,becoming the main category of crime.In response,China's prosecution model has also shifted from a proactive stance to a more cost-effective approach,gradually expanding the scope for the application of non-prosecution.In the judicial practice,due to the deficiencies of non-prosecution system,its inconsistent application standards,lack of strict adherence to standards,inadequate relief channels,etc.,many problems become prevalent in the practical implementation of this system.Based on the actual situation of procuratorial supervision in case-handling,the procuratorial organs should continuously improve the top-level design,construct supervision and restraint mechanisms,innovate case-handling models,especially ensure the scientific operation of the non-prosecution system,thereby better achieving the value goals of the non-prosecution system and helping to enhance the modernization level of the social governance system and governance capacity.
