摘要
2022年我国《体育法》的修订有力地回应了近几年社会各界的广泛呼声。具体而言,在体育仲裁方面着重笔墨,单开一章,作为《仲裁法》之外的有效补充,此外还促成了中国体育仲裁委员会的成立以及《体育仲裁规则》和《中国体育仲裁委员会组织规则》的出台。本文运用文献分析和法条分析的方法,对我国体育仲裁的独特内涵进行研究,发现我国体育仲裁具有独立运作与官方指导的结合、仲裁终局性与司法终局性的协调、原则与例外的统一、法定管辖与意定管辖的交叉、调解与仲裁的并行、反兴奋剂与仲裁的结合等独特内涵。我国体育仲裁的未来发展方向应重点完善体育仲裁可仲裁的纠纷范围、完善体育仲裁与体育组织内部纠纷解决机制的联系。
The revision of China's Sports Law in 2022 has effectively responded to the widespread calls from various sectors of society in recent years.Specifically,in terms of sports arbitration,emphasis has been placed on writing,with a separate chapter as an effective supplement to the Arbitration Law.In addition,it has also facilitated the establishment of the China Sports Arbitration Commission and the introduction of the Sports Arbitration Rules and the Organization Rules of the China Sports Arbitration Commission.This article uses the methods of literature analysis and legal clause analysis to study the unique connotations of sports arbitration in China.It is found that sports arbitration in China has unique connotations such as the combination of independent operation and official guidance,the coordination of arbitration finality and judicial finality,the unity of principles and exceptions,the intersection of legal and voluntary jurisdiction,the parallel mediation and arbitration,the combination of anti doping and arbitration.The future development direction of sports arbitration in our country should focus on improving the scope of disputes that can be arbitrated in sports arbitration,and improving the connection between sports arbitration and the internal dispute resolution mechanism of sports organizations.
