摘要
通过梳理国外数字经济立法策略以及我国的数字经济立法探索可知,“问题对策”立法模式是占主导地位的数字经济立法模式,该模式导致数字经济法律制度的“碎片化”以及数字经济的“割裂式”发展。关于数字经济立法,目前学界提出了回归部门法和单行法两种思路,但本质上仍然属于“问题—对策”立法模式。数字经济要素化和数字经济法律体系化之间具有某种“契合”关系,因此“要素—体系”立法模式有其正当性基础和实践性价值。从系统论角度来看,数字经济法律体系包括内部系统和外部系统,前者是基于数字经济基本制度、基础制度和关键制度而形成的“一以贯之”的规范体系;后者是数字经济立法受顶层设计、部门法和地方立法影响而不断完善的规范体系。我国应该制定《数字经济法通则》,以统摄相关单行法和部门法中的数字经济法律规范,最终形成数字经济法律的体系化架构。
Through sorting out foreign digital economy legislative strategies and China’s digital economy legislative exploration,it can be seen that the“problem-countermeasure”legislative model is the dominant digital economy legislative model,which leads to the fragmentation of the digital economy legal system and the“fragmented”development of the digital economy.With regard to digital economy legislation,academics have put forward the idea of returning to branch laws and individual laws,but they still belong to the“problem-countermeasure”legislative model.There is a certain“fitness”between the elements of the digital economy and the legal system of the digital economy,so the“element-system”legislative model has its legitimate basis and practical value.From the perspective of systematology,the legal system of digital economy includes internal system and external system,the former refers to the consistent normative system based on the basic system,fundamental system and key system of digital economy,the latter refers to the normative system that is continuously improved by the influence of the top-level design,branch laws and local legislation of the legislation of digital economy.China should formulate the General Principles of Digital Economy Law,in order to unify the legal norms of the digital economy in the relevant individual laws and branch laws,and ultimately realise the systematic structure of digital economy law.
