摘要
建设人民法院案例库,旨在最大限度发挥案例的实用效能,通过权威、规范的案例促进法律统一适用、抓实诉源治理、深化司法公开、提升司法能力。案例库上线并面向社会开放,标志着案例库建设工作迈出关键性一步。案例库收录最高人民法院发布的指导性案例和经最高人民法院审核的参考案例。参考案例体例规范、要素齐全,重在规则指引,兼顾规范引领,入库标准严格。入库案例具有权威效力,各级人民法院审理案件,应当检索案例库,严格依照法律和司法解释、规范性文件,并参考入库类似案例作出裁判。案例库实行动态调整机制,最高人民法院将持续补充、更新、清理相关案例。首批入库案例具有精准服务大局、注重案件“新鲜度”、直面法律争议问题、注重规范引领等特点。
The Supreme People's Court has decided to build the case base of the People's Court in order to maximize the practical effectiveness of the cases,and promote the unified application of law,promote the deepening of the reduction of litigation sources,promote the deepening of judicial openness and the improvement of judicial capacity through authoritative and standardized cases.The case base is online and open to the public,marking a key step in the construction of the case base and entering a new stage of development.The case base contains the guiding cases issued by the Supreme People's Court and the reference cases examined by the Supreme People's Court.The style of the reference case is standardized and the elements are complete.In terms of warehousing standard,the emphasis is on the guidance of rules,taking into account the guidance of norms,and the warehousing standard is strict.Stored cases have authoritative effect,and people's courts at all levels should search and consult the case base when hearing cases,make judgments strictly in accordance with laws,judicial interpretations and normative documents,and refer to similar cases in the database.The case base implements a dynamic adjustment mechanism,and the Supreme People's Court will continue to supplement,update and clean up relevant cases.The first batch of warehousing cases have the characteristics of precise service to the overall situation,focusing on the"freshness"of cases,facing legal disputes directly,and focusing on normative guidance.
