摘要
加快涉外法治工作战略布局,事关涉外法治工作的顶层设计,是统筹推进国内法治和涉外法治的关键环节。现有的涉外法治研究主要是从职能角度出发,关注涉外立法、执法、司法和法律服务等领域的内容,对涉外法治工作战略布局缺乏必要的关注。现阶段,涉外法治工作战略布局可重点关注以下三个维度:一是政策层面的战略规划。涉外法治具有内在的特殊性,需要研究制定专门的战略规划,包括专门战略规划体系和统筹协调机制。二是规范层面的法治措施。为丰富涉外法治措施储备,应从整体上优化涉外法治规范体系。除了健全涉外法律法规体系,加强我国法域外适用法律体系建设,还有必要建设国际条约和判例数据库。三是实施层面的应对机制。涉外法治工作应对机制的建立,应当致力于应对国家利益面临的风险挑战,主要涵盖法律风险预警机制、法律争端解决机制、涉外法务工作机制和国际交流合作机制等领域。涉外法治工作战略布局需要与国内法治紧密衔接,共同服务国内国际两个大局。
Accelerating the strategic layout of the foreign-related rule of law is crucial for the top-level design of the construction of the foreign-related rule of law,and it is a key link in coordinating the development of domestic and foreign-related rule of law.Existing research on the foreign-related rule of law mainly starts from a functional perspective,focusing on areas such as foreign-related legislation,law enforcement,judiciary,and legal services,but lacks necessary attention to its strategic layout.At this stage,the strategic layout of the foreign-related rule of law can focus on the following three dimensions:First,the strategic planning at the policy level.Foreign-related rule of law has inherent characteristics that require the formulation of specialized strategic plans,including specific strategic planning systems and coordination mechanisms.Second,legal measures at the normative level.To enrich the reserve of legal measures for foreign-related matters,the overall optimization of the normative system should be pursued.In addition to improving the system of foreign laws and regulations and strengthening the construction of laws applicable outside China's jurisdiction,it is also necessary to establish international treaty and case law databases.Third,the response mechanisms at the implementation level.The establishment of response mechanisms for foreign-related rule of law should focus on addressing the risks and challenges faced by national interests,mainly covering areas such as legal risk warning mechanisms,legal dispute resolution mechanisms,foreign-related legal affairs mechanisms,and international exchange and cooperation mechanisms.The strategic layout of the foreign-related rule of law needs to be closely integrated with the domestic rule of law to jointly serve both domestic and international situations.
