摘要
“应检未检”行为是动物及动物产品检疫工作中最为常见的违法行为之一。为完善动物检疫相关法律制度,新版《中华人民共和国动物防疫法》对这种违法行为的相关法条进行了修改。然而,在综合执法实践中,不少同行在处理此类案件时仍存在一些迷惑。为此,本文梳理了两个违法案例,并以此为基础,介绍了有关的法律依据、检疫监督执法主体、补检等相关规定,然后结合国家有关规定提出了一些见解和工作建议,以期为同行执法提供参考。
The behavior of“being supposed to have been inspected”is one of the most common violations found in the practice of inspection and quarantine of animals and their products.In order to improve the legal system related to animal inspection and quarantine,relevant regulations have been amended in the Law of the People's Republic of China on Animal Disease Prevention.But there are still some confusions for some law enforcement officers during their practice in dealing with such cases.To this end,two cases were reviewed in the paper,based on which,relevant regulations related to legal basis,actors of quarantine supervision and law enforcement,supplementary inspection and others,were introduced,followed by some comments and recommendations according to relevant national provisions,expecting to assist officers in their law enforcement.
