摘要
智能汽车交通事故侵权的责任主体认定作为人工智能应用领域的一个焦点问题受到了各界广泛的关注,也是“人—机关系”难题的集中体现。但就目前的社会发展程度而言,赋予智能汽车以法律主体地位的制度成本太高,可行性不强。在此背景下,按照国家现行技术标准对智能汽车事故侵权的责任主体展开分级研究显得更为切实,即根据具体情况分级适用驾驶人责任与保有人责任,并引入智能汽车生产者作为该类交通事故侵权的责任主体。
As a focus issue in the field of artificial intelligence application,the identification of liability subjects for intelligent vehicle traffic accident infringement has attracted wide attention from all walks of life.It is also the concentrated embodiment of the problem of"human-machine relationship".However,in terms of the current degree of social development,the system cost of giving intelligent cars the legal sub⁃ject status is too high and the feasibility is not strong.In this context,it is more practical to carry out hi⁃erarchical research on the liability subjects of intelligent vehicle traffic accident tort according to the cur⁃rent national technical standards.That is to say,apply the driver liability and owner liability according to the specific situation,and introduce the intelligent vehicle producer as one of the subjects of liability for infringement of such traffic accidents.
